Court Rules Andile Lungisa's Removal From ANC Candidate List Unlawful

JOHANNESBURG, SOUTH AFRICA — 9 October 2026

The Gauteng High Court in Johannesburg has ruled that the African National Congress (ANC) unlawfully removed senior party member Andile Lungisa from its proportional representation candidate list for Nelson Mandela Bay ahead of South Africa's November 2026 local government elections.

In a judgment delivered on Friday, Judge Nelisa Mali declared the decision unconstitutional, unlawful and invalid, ordering the ANC to restore Lungisa's name to its internal candidate list.

How the Dispute Started

Lungisa, a member of the ANC's National Executive Committee, challenged his removal after discovering that his name had been excluded from the party's final candidate submissions.

He argued that ANC branches in Nelson Mandela Bay had supported his nomination and that he had progressed through the party's internal candidate-selection process.

The dispute involved ANC Secretary-General Fikile Mbalula, whose authority to remove Lungisa became a central issue in the court proceedings.

Court Questions Candidate-Selection Process

The ANC defended its decision by raising concerns about Lungisa's vetting process and eligibility requirements.

However, the court found that the party had not adequately established that Lungisa had failed to participate in the required vetting procedures.

The judgment also found insufficient grounds to conclude that Mbalula had the authority to remove Lungisa unilaterally at that stage of the selection process.

The court declined to hold Mbalula personally liable.

ANC Ordered to Reinstate Lungisa

The High Court directed the ANC to restore Lungisa's name to its internal proportional representation candidate list.

The ruling also provides for his name to be submitted on a supplementary list if the Electoral Commission of South Africa permits such a submission under the applicable legislation.

This means the judgment does not automatically guarantee Lungisa a place on the ballot for the upcoming elections.

The ANC and Mbalula were also ordered to pay Lungisa's legal costs.

ANC Plans to Appeal

Following the ruling, the ANC reportedly confirmed that it intends to appeal the judgment.

The development adds another stage to the dispute over the party's candidate-selection procedures.

South Africa's local government elections are scheduled for 4 November 2026.
